John Richard is one of the founding partners of Continuum Legal Group. He has worked in commercial litigation and creditors’ rights for over twenty years, concentrating on resolution of creditor/debtor disputes, corporate and entity governance issues, and financial and real estate disputes. John represents clients in connection with loan and special asset workouts, lender participation disputes, lender liability claims, mortgage and financial fraud matters, and complex post-judgment collection matters, all to maximize the client’s financial recovery.
John has extensive experience in working with troubled loans and guiding banks and other lending institutions through loan administration, workout, special asset litigation, and foreclosure processes. John has counseled large national banks, community banks throughout Georgia and beyond, as well as the Federal Deposit Insurance Corporation on loan restructuring, workouts, receiverships, and troubled asset management.
John represents both plaintiffs and defendants in complex litigation involving corporate control and governance disputes, leasing and landlord/tenant disputes, and general commercial litigation. John also advises clients on an ongoing basis regarding various methods of avoiding litigation and making litigation more effective and efficient when it is necessary.
Prior to joining Continuum, John spent fourteen years at a full-service business law-firm in Atlanta, the last twelve of which as a partner and the leader of the Creditors’ Rights practice. Prior to that, John practiced in the Securities, Corporate, and Financial Litigation department of a national law firm in Atlanta. John has been selected by his peers in the legal community as one of Georgia Trend Magazine’s “Legal Elite” in the area of Creditors’ Rights multiple times.
Practice Highlights
- Represented the Federal Deposit Insurance Corporation, lenders, and other loan holders during and since the Great Recession in thousands of matters to collect loans, foreclose on real and personal property collateral, and successfully resolve all manner of ‘bad debt’
- Represented creditors in taking back collateral as varied as jewelry store inventory, peach orchards, and aircraft, among other items pledged
- Counsel to various institutional and individual landlords in commercial leasing and dispossessory/eviction disputes
- Represented non-profit churches in corporate control disputes to protect church property and intangible rights
